This site is owned and operated by Blue Cross Blue Shield of Delaware (referred to as BCBSD herein). Any activity on this site is subject to monitoring by BCBSD at any time. Any one who uses this site consents to such monitoring and agrees that BCBSD may use the results of such monitoring without limitation. No material from any web site owned, operated, controlled or licensed by BCBSD or any of its related affiliated companies (the 'BCBSD Material') may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without prior written consent of BCBSD, except that you may download one copy of the BCBSD Material on any single computer for your personal, non-commercial use only. You agree that BCBSD may immediately terminate its services if you breach these conditions of use or if you have jeopardized the proper and efficient operation of its services. Any unauthorized use of BCBSD Web site services, whatsoever, shall result in automatic termination of these services.

4. To the extent that BCBSD utilizes Internet services to transport data or communications, BCBSD will take reasonable security precautions, but BCBSD disclaims any liability for interception of any such data or communications. BCBSD shall not be responsible for, and makes no warranties regarding, the access, speed or availability of Internet or network services.

5. You recognize that your use of BCBSD Web-based information services may involve the transmission to you of information that may be considered privileged and confidential medical information. You consent to the transmission by electronic means of such information through the service or product named or referred to in the preceding sentence; such consent shall be effective at all times that you use any such system, service or product.

You agree to indemnify and hold BCBSD harmless from all damages, including reasonable attorney's fees, in any action, claim or suit brought by a third party alleging an improper disclosure of medical records or any other violation of terms and conditions herein.

6. You acknowledge that by registering to use the BCBSD Web site, you have authority to view any privileged or confidential medical or personal information to which you may request access. You also acknowledge that improper use or disclosure of any information deemed privileged or confidential may lead to all appropriate civil and criminal sanctions.

7. Under no circumstances, including, but not limited to, negligence, shall BCBSD or any of its related, affiliated companies be liable for any direct, indirect, incidental, special, consequential or punitive damages that result from the use of, or inability to use, the BCBSD Material. You specifically acknowledge and agree that BCBSD is not liable for any defamatory, offensive or illegal conduct of any user.
